COLLECTIVE MADNESS

“Soft despotism is a term coined by Alexis de Tocqueville describing the state into which a country overrun by "a network of small complicated rules" might degrade. Soft despotism is different from despotism (also called 'hard despotism') in the sense that it is not obvious to the people."

Is a Googled World Anathema to the Fourth Amendment?

FOURTH AMENDMENT U.S. Constitution -
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.'

Why should your non-public business become part of a universal and perpetual record on the internet? If one does not want to borrow money, what right does someone have to keep, maintain and sell a dossier of your financial affairs? Why should someone be able to type in your address and get a satellite photo of your entire property? That used to be call a spy photo.

There is no right of privacy, but there should be, and a person should be able to opt out of an intrusive system that is only possible with the technology created in one generation. It is past time to to stop the continued erosion of a basic human need. We admonish a child not to stare so why should our private business be available to worldwide scrutiny?

We must allow a person to keep private affairs private. It is not a question of having something to hide. A person that wants privacy should not have the burden of giving their reasons for privacy. After all, that is private too.

  2. First Ammendment:

    Pre-emptive PC defeat:
Bill Cunningham is censored and apologized for for using Obama's middle name.
MSM joins in condemning the evil right-wingers from Bill Cunningham to the rest of the conservative media.
National GOP puts Tennessee Republicans on notice not to continue to use Obama's
    middle name.

So as with GWB, our behavior, our rules are established by our adversaries.

Unlike GWB, McCain does not wait until he is elected to wage pre-emptive defeat, ensuring he never will be elected!
Barry does not like being called a liberal, will citizen Cain Comply? No one calls Barry Dumbo anymore, either, ever since he chastised Dowd for making fun of his Elephant Ears.
Barry gets what he wants, with the active co-operation/surrender, of his "opponents."

  3. I would suggest you adopt Trish's policy wrt Mat's first question!

But I would add, the time is long past when there was any chance of preserving our right to privacy.

  5. The coppers are going to be able to--maybe can--listen to the converstation in your home by picking up the vibrations caused by your voice on your windowpane. With some imaging device they are going to be able to look inside, see if you got a gun in your hand. Paranoid yet? For a few bucks anybody can find out almost anything about anyone else, simply through peoplefinders, or intellius, or whatever. Even I, sitting here, know Hayduke is in the Green River area, info gets passed around at the speed of light. Our court, here, has ruled, I think, that they can't pump your stomach, that being morally reprehensible or some such language, so your stomach contents are your own, here in Idaho at least. It's scary, these constitutional questions being decided by the judges. On the other hand Larry Craig maintains you have a right to privacy, or an expectation of privacy, in the restroom in the airport, so maybe we ought to conduct all our business there.

  9. Action Alert from Team Nader --

Today, at a noon EST press conference in downtown Washington, D.C., Ralph Nader will announce his VP running mate.

This evening, they will speak at George Washington University.

Now, just a word of thanks.

Late Monday, we put out a call for donations to the campaign in honor of Ralph's birthday.

We said that over the course of two days, we wanted to raise $50,000 from 500 of you.

And you came through with flying colors - we raised $56,663.32 from 767 of you.

Thank you for your dedication and generosity.

We printed all of your names out, included them in a giant birthday card, and presented it last night to Ralph.

    Happy Birthday Ralph!

Now, let's continue to spread the word.

Get your friends and family to sign up.

And let's get Ralph on the ballot all across the country.

    Onward.

  11. My name's not on Ralph's Birthday Card. I'm just on his mailing list. I think Ralph is a decent guy. Dad talked to him long ago, after Unsafe At Any Speed, after one of my aunts died in a car accident. Brand new Chrysler with a push button transmission, that took of like a shot, the carburator stuck open, we think, crashed into a brick wall in Pullman. He connected us with an engineer in Texas who came and inspected the car, finding a red nailpolish markings on the linkage, which he said showed it had been recycled in the production line. Nothing came of it tough, it was too hard a case to take on, the evidence slim, on what happened. Tough to sue the car companies then.

  12. Deuce, I presume you are consistent and you vehemently oppose Bush's spying, you know, all that FISA stuff he's trying to push? Bush should be brought up on charges for the illegal spying he's authorized - you on board with that? You should be.

  13. “There is no authority by which persons may wholly ignore a subpoena and fail to appear as directed because a President unilaterally instructs them to do so,” Pelosi told Mukasey in Thursday’s letter.

“Even if a subpoenaed witness intends to assert a privilege in response to questions, the witness is not at liberty to disregard the subpoena and fail to appear at the required time and place. Surely, your Department would not tolerate that type of action if the witness were subpoenaed to a federal grand jury,” she wrote…”I strongly urge you to reconsider your position and to ensure that our nation is operating under the rule of law and not at presidential whim.”

In addition to approving the criminal contempt citations against Bolten and Miers, House Judiciary Committee Chairman John Conyers (D-Mich.) was authorized to initiate a civil-contempt action against the two Bush aides.

  14. Ash, there is a distinction between a focused review of persons of interest by a government agency charged with protecting the security of the US and a data base that just accumulates information for one and all with no security or review. Why should the layout of your home grounds be available to anyone?

In Kyllo vs. United States, the Supreme Court ruled that the use of sensory-enhancing technology to see through traditional privacy barriers constituted an illegal search in violation of the Constitution’s Fourth Amendment protections. That should apply to data aggregators.

  15. The measure, which passed by a 104-51 vote, also allows police to take rented and leased vehicles if the owner knew, or "should have known," the driver was an illegal immigrant. It now goes to the Senate.

It's the latest plan by Georgia lawmakers targeting illegal immigrants.

The Senate passed two measures this month that would outlaw so-called sanctuary cities _ where officials are banned from reporting illegal immigrants _ and allow prosecutors to level a felony charge against people driving without a valid driver's license.

Pelosi, at the bidding of the greedy, traitorous trial lawyers won't let it get to a vote.

    and for Rat from isioz:

"The so-called virtual fence was an awfully silly idea to begin with, and the fact that the virtual has failed totally as the actual is not exactly surprising. I mean, they're going to spend $8 motherfucking billion on some kind of fanciful scifi pipe dream. I can't wait until they announce that there was no majority report. You know how many dune buggies and border agents you can get--and for how long!--for $8 motherfucking billion? Personally, I'm in favor of open borders as a prelude to the destruction of human society and a return to matriarchal hunter-gathering, but honestly, there is very little that sensitive, finicky, high-techery can accomplish that some dudes with binoculars can't. If one were a cynic, one might suspect that both the idea of the virtual fence and the practical failure of its application were smoke and mirrors intended to camouflage the fact that our government is not in fact interested in staunching the necessary flow of cheaper labor into the United States. Surely, though, that couldn't be the case."

  19. Rep. Jeff Fortenberry
(R-Neb.), has once again voted with Nancy Pelosi and against taxpayers in
the Neb. 1st District. By voting for H.R. 5351, the "Renewable Energy and
Energy Conservation Tax Act of 2008", the Nebraska Congressman voted to
raise taxes on his constituents for the fourth time. Americans for Tax
Reform strongly urges voters in the 1st District to consider the following:

-- H.R. 6, the so-called "CLEAN Energy Act of 2007", was the first tax
increase at the federal level in thirteen years. The Democrat-controlled
House, with Rep. Fortenberry's support, forced a vote in its first fifteen
days to raise taxes on domestic energy production, subsequently lowering
the value of millions of Americans' retirement funds.

-- H.R. 2419, the "Farm Bill" was touted by socialist radicals as
reform, and Rep. Fortenberry voted for its passage -- but it is nothing of
the sort. It is more of the misguided subsidies that prevent the free
marker from existing in agriculture, drives up prices, and rewards the
richest corporate farms with tax dollars.

-- H.R. 3221, the alleged, "New Direction for Energy Independence,
National Security, and Consumer Protection Act" was an egregious tax-laden,
anti-consumer piece of legislation that sought to increase the cost of
appliances and decrease consumer choice, regulate corporate business models
of the auto-industry, and mandate local utilities use a certain percentage
of "renewable" energy which passes the cost and taxes directly onto the
    consumer.

I didn't know that. Good for the US Supreme Court, for once.

In Idaho, I think I'm right on this, they can't pump your stomach, but they can examine your stool. Which makes some kind of sense, but I don't know what to name it, and better not try.

  23. Another thing I got against Buckley. He thought he had a great idea, a real revelation, a mighty breakthrough in thought, coming out for legalizing drugs as he did. Not that every junkie on the street hasn't had the idea many times, and long before Buckley. It's one of those examples of where is right and most everybody else wrong, as he would say, nobody having been right all the time, like Bill.

A population that is drugged to death won't have a lot of revolutionary or political ferver, maybe he is thinking along those lines, but I don't know, just a maybe.

  24. Prohibition, bob. On balance, good or bad?

    ReplyDelete
  25. A bottle of wine and a syringe full of heroin are not the same.

Prohibition on balance was probably bad.

Booze and drugs, William James said, are an attempt to conjure a visitation of the Lord, without the purging of self, and the change and illumination the masters of the spiritual life have been telling us that visitation requires.

What can easily kill us ought to be outlawed, as best we can do, I think. We've been through this discussion before.

What would Jesus do?:) He is reported to have changed water into wine at Cana.(Mat, this story is sometimes used to argue that Jesus might have been married, as he seems to be fulfilling the duties of a Jewish host in the incident, and it is claimed that the groom would be the one to do this, serve the wine, but I don't know Jewish wedding customs.) But the gospels make no mention of the really addictive poisons Buckley wanted to legalize. It would be interesting to have heard Buckley answer this question, maybe. Be a lot more interesting to hear Jesus answer it.
