Missing Man Formation.

There is no comeback for John McCain. He pealed off from the Republican formation and he is not coming back. It is likely that the Republicans will be picking from Guiliani, Romney or possibly Fred Thompson. I think Thompson a remote possibility. I would also bet money on Hillary as the ultimate Democratic candidate. There is plenty of time left and that can be a problem for either party. Who else is out there and who do you like?


Gingrich Assesses the Republican Field

During a speech in Washington this morning, former House Speaker Newt Gingrich gently praised several fellow Republicans who have launched presidential bids, criticized one and offered few clues about the chances he would step into the race.

Mr. Gingrich touted Rudolph W. Giuliani’s “extraordinary achievements” as mayor of New York, and said that as a candidate he “has certainly done better so far than people would have guessed.” Former Gov. Mitt Romney, he added, is a “very serious person who is working very hard.” If former Senator Fred Thompson enters the race, he would be a “very formidable” candidate.

Left out of Mr. Gingrich’s top three was Senator John McCain, who he said is facing “the greatest challenge in the Republican primary,” because of his association with the McCain-Feingold campaign finance legislation and the immigration bill he co-sponsored, which stalled in the Senate yesterday. (Mr. Gingrich, like many conservatives, does not support either piece of legislation.)

As for the prospect of his own candidacy, Mr. Gingrich said that he would confer with his wife in late September and make a decision about whether he would enter the crowded field of Republicans vying for the party’s nomination.

“My position is unchanged,” Mr. Gingrich said. “If there is a real genuine vacuum, we may feel compelled to run.”

Earlier this week Mr. Gingrich told the Associated Press that he gave himself 4-to-1 odds against running for president despite previous statements in which he did not lay down odds on a presidential bid. A spokesman for the former House Speaker said that for now, Mr. Gingrich was far more focused on his “American Solutions” project, which was the topic of his speech this morning at the American Enterprise Institute. (Its website has posted video/audio from the event.)

But Mr. Gingrich did not pass up the opportunity to once again take aim at the Bush administration, particularly on the issue of border security. Mr. Gingrich, who is no fan of the immigration bill that was hotly debated this week, sharply criticized Homeland Security Secretary Michael Chertoff for his recent remark that by supporting the compromise bill, the administration was “bowing to reality.”

“We Americans know that bowing to reality is the opposite of our tradition,” Mr. Gingrich said.

    "Yes," he replied.

    Dinsmore, whose testimony was videotaped in March, said he doubted prosecutors could be objective given the political climate surrounding the case, and said Chessani was "above reproach."

    Sullivan said his job as a prosecutor was to ensure justice was done fairly.

    The Haditha killings sparked the biggest criminal case against U.S. troops in the war in Iraq, with three enlisted Marines charged with murder and the four officers accused of dereliction.

    The two dozen people were slain after a roadside bomb killed Lance Cpl. Miguel Terrazas who was driving a Humvee. In the aftermath, Marines went house to house looking for insurgents.

    They used fragmentation grenades and machine guns to clear the homes, but instead of hitting insurgents, they killed civilians.

  33. I must apologize for failing to mention that the dead women and children at Haditha were not killed or wounded by shrapnel as initially reported. Each was neatly popped with a single round to the head. Oh, all were found in one bedroom in one house.

    Lt. Col. Chessani certainly is correct on one point, Marines are not murderers. That is why the Corps is undertaking the Article 32 Investigations.

    There does seem to be some confusion: there is not a shred of evidence showing the execution style killing of women and children at Fallujah. If you, DR, have evidence to the contrary, publish.

    The Marine Corps has NEVER promulgated rules of engagement that contemplate or authorize the cold-blooded murder of women and children by gangland execution methods. Clearly, someone has the Marine Corps confused with the SS.

  50. Had women and children in Lebanon been found dead, en masse, in bedrooms, with single shots to the back of the head, it would be reasonable to assume foul play. Since they were not, what is your point, Doug?

    Additionally, no such finding was made with reference to women and children killed in Fallujah; consequently, the deaths of women and children at Haditha and Fallujah are incomparable – apples and Martians.

    The point of the Article 32 Investigation of Lt. Col. Chessani is to establish whether he knew or should have reasonably known that an investigation of the event was in order. If the hearing officer determines that the Lt. Col. was derelict, Chessani will face the possibility of court-martial.

  59. The women and children killed at Haditha were killed by the Marines. The accused Marines do not deny this, nor do their attorneys. Additionally, there is no dispute as to the site of the killings. What is at question is whether the head shots were the result of exceptionally fine marksmanship or assassination.

  66. The initial report filed by the Marines claimed that the women and children had been inadvertantly killed by a combination of grenade shrapnel and small arms fire. Evidence presented at the Article 32 Investigation of Lt. Col. Chessani points to the cause of death as coming from point-blank head shots. When given the opportunity to dispute the government's expert witness on this score, the defense had no questions.

    For any number of reasons, the defense can pass; often doing so to avoid potentially damaging redirection by the prosecution. I have no idea why the defense passed on cross examination in the instance; however, in doing so the defense has not waived the right to dispute the expert testimony if Lt. Col. Chessani goes to court-martial, assuming there is anything to dispute.

    I have no opinion as to the Lt. Col's guilt or innocence; that will be determined by the evidence presented at court-martial, assuming his case goes to trial.

    When all is said and done, the integrity of the Corps will be vindicated. Doubtless, Lt. Col. Chessani, an honorable man, would not have it otherwise.

    Lt. Col. Chessani's difficulties arise from the claim by his superiors, including Major General Huck, that Chessani "mislead" them - hence, the charges of dereliction. That is not my opinion; rather, it is the matter of sworn testimony. Whether Lt. Col. Chessani is found to have been derelict remains to be proved. Somehow, though, I don't think that will matter to you.

    CAMP PENDLETON ---- The deaths of at least five Iraqi women and children shot in the head in Iraq in 2005 by members of a Camp Pendleton squad should have raised enough suspicion from Marine commanders for them to order an immediate investigation, a Pentagon law of war expert said Thursday.

    In all, 24 Iraqi civilians died at the hands of the Marines on Nov. 19 in the village of Haditha. The sheer number of deaths should have set off alarms throughout the chain of command, said the expert, longtime Defense Department attorney and law of war specialist W. Hays Parks.

    Parks' comments came during testimony on the second day of a hearing to determine whether a Marine officer should face trial on dereliction of duty charges for failing to order a probe into killings that took place after a roadside bomb destroyed a Humvee. A lance corporal was killed and two other Marines were injured in the explosion.


    The officer at the center of the hearing, Lt. Col. Jeffrey Chessani, was commander of the 3rd Battalion, 1st Marine Regiment in Haditha when the killings occurred. Three other officers face similar charges, and three enlisted men face murder charges.

    The prosecutor, Lt. Col. Paul Atterbury, described in graphic terms how some of the victims died. He said that the women and children found in a bedroom in one of four homes stormed by the Marines after the bombing appeared to have died from head wounds.

    Given that detail, Parks said that even a cursory examination by commanders on the scene should have indicated that something was wrong.

    "The substantial number of head shots does not suggest a resisting force," Parks said.

    The two months that elapsed before an investigation was launched in the wake of questions from a Time magazine journalist resulted in more harm to U.S. prestige than an immediate probe would have generated, Parks said.

    "Bad news doesn't get any better with time," said Parks, a former Marine Corps officer who has worked on war law issues for the Defense Department for more than three decades and serves as a legal adviser for special operations missions. "It just makes the situation worse."

    The Marines who carried out the killings contended the civilians died as a result of crossfire during a small arms attack the Kilo Company squad faced immediately after the bombing.

    However, a later investigation by U.S. officials showed that 19 of the Iraqis died after Marines entered three homes in which no insurgents were found and no weapons were recovered.

    Five men who drove up immediately after the bombing were the first Iraqis to die, killed after being ordered out of their car and held at gunpoint with their hands in the air, according to testimony from one of the Marines who took part in their shooting.

    Called by the government, Parks spent more than six hours on the stand, spending much of it explaining how he helped write a regulation that requires an investigation whenever a "possible, alleged or suspected" violation of the law of war occurs.

    After hearing several descriptions from Atterbury about what happened in Haditha, Parks said: "The fact is, a crime appears to have been committed. How could you not investigate that?"

    The lack of any insurgent bodies or weapons being recovered from the car or any of the homes presented other red flags, he said.

    When the prosecution finished its questioning, Chessani's military attorney, Lt. Col. John Shuleburne, rose and said the defense would have no questions.

    One of the Chessani's civilian attorneys, Brian Rooney, later said the defense will contend that he reported the killings up the chain of command immediately after learning of them and that higher-ranking Marines needed to determine if a formal investigation was warranted, Rooney said.

    The only other witness to appear Thursday, Lt. Col. Eric Smith, was called by prosecutors to give his opinion on the responsibilities of a battalion commander.

    "If you shoot and injure or kill someone that didn't need to be killed, I'm going to investigate that," said Smith, who has served three combat tours.

    Testimony in the hearing continues this morning and is expected to last through the end of next week. If ordered to trial and convicted, Chessani could face more than two years in prison and dismissal from the service.

The video was obtained by the Hammurabi Human Rights Group, which cooperates with the internationally respected Human Rights Watch, and has been shared with TIME.'" In fact, Human Rights Watch has no ties or association with the Hammurabi Human Rights Group. TIME regrets the error."

    On Friday May 26th, 2006, Time's Matthew Cooper wrote "In the original version of this story, TIME reported that 'one of the most damning pieces of evidence investigators have in their possession, John Sifton of Human Rights Watch told Time's Tim McGirk, is a photo, taken by a Marine with his cell phone that shows Iraqis kneeling — and thus posing no threat — before they were shot.' While Sifton did tell TIME that there was photographic evidence, taken by Marines, he had only heard about the specific content of the photos from reports done by NBC, and had no firsthand knowledge. TIME regrets the error."

    It's worth noting that no such photographic evidence ever surfaced despite strenuous efforts by investigators to locate it.

    Later it turned out that McGirk's so-called "journalism student" was in reality a 43-year old insurgent propagandist Thaer Thabit al-Hadithi who together with Abdul-Rahman al-Mashhadani, another known insurgent propagandist, constituted the entire membership of the Hammurabi Human Rights Group.

    An Article 32 Investigation is not a trial; therefore, at this writing, no one is guilty of anything, nor will they be at the end of the investigation.

    If the prosecution can convince the hearing officer that the government has sufficient cause to advance the case to trial and the division commander agrees, then, at court-martial the facts of the case and guilt or innocence will be established. All the hyperventilation prior to court-martial is just noise.

    In the case of Lt. Col. Chessani, the facts, and not the ill-considered public ruminations of his defense team, will determine his fate. Unlike the civilian judicial system, where F. Lee Bailey, Johnny Cochran et al thrive on slander, lies, and hyperbole, the military justice system takes a very dim view of theatrics and clowns. If the quotes attributed to Mr. Rooney are accurate, he would be well advised to cut the crap and make Lt. Col. Chessani’s case.
