    Good morning Mia,



    First, welcome to the world of municipal law! I hope you are enjoying the learning
    experience. I remember when I first started dabbling in it and there is a lot to
    take in. I still learn new things each time I attend a council meeting.



    My client just dropped off a letter from you regarding payment of
    a City of Moscow utility bill incurred by his tenant Adriana W., Account Number
    xxxxxx-000. While I understand the City of Moscow ordinances provide that property
    owners are responsible for the charges, regardless of their use, occupancy, or
    whether or not the owner agreed to it, Idaho law makes that ordinance unenforceable.



    I am attaching the case of the City of Grangeville v. Haskin, which is on point. In
    that case the City of Grangeville had a similar ordinance which provided the
    property owner was responsible for the charges. The Court found that if the record
    owner did not actually use the service or enter into an agreement to pay the bill
    with the City, the City could not require the property owner to pay it; regardless
    of the ordinance. My research has not revealed any reversal of this case.



    This has come up a couple of times in my representation of the City of Troy and City
    of Deary, both of which have similar ordinances as the City of Moscow. A couple
    years ago I had a conversation with Rod H. about the issue as well. His response
    was that they just let it go if a property owner pushes back. The reality is that
    the ordinance should be modified to be consistent with Idaho law. I think there is
    a reluctance to change the ordinance because most of the time the owner just pays
    since he/she is not familiar with the law.



    Based upon Idaho law, your recourse for payment of the city charges rests solely
    with Ms. W. as my clients have not agreed to pay the City for those charges. If I
    am mistaken and the City has an agreement with Mr. and Mrs. X to pay those
    charges, please send me that agreement so I can provide it to my clients.



    If you have questions or would like to dialog this matter further, I would be happy
    to do so. It is a matter that I have discussed with Gary in the past as well. Once
    you have had an opportunity to review the case and the matter further, I would
    appreciate confirmation from you regarding the City’s position of my clients’
    liability.

    The Court found, reasonably enough, that absent some agreement with the City to the contrary, the tenant who gets the benefits of the water usage is responsible for the water bill.

    It all worked out exactly as my lawyer S. predicted. She said the City would send me a formal letter trying to stiff me and pick my pocket. And they did.

    I told my lawyer S. to tell the Assistant City Attorney, M., that I, being over 70 years of age and having had my pocket picked by the City with regularity over the decades, in many ways, am urging my lawyer to file a Class Action Fraud Suit with punaiive damages against the City.

    I am joking, I think. I might do so but S. would never take the case, at least,I don't think so at this time.

    1. To make this from my point of view shocking matter even worse - my father, bless his memory, gave free with a deed of gift to the City the land upon which the providing well in question draws pure water for the benefit of all Moscow residents.

      It was the first deep well we ever had, drawing from the Grande Rhonde Aquifer, sucking melt water from the last ice age, 20,ooo years ago....and in all these years the water level of that deep well has not dropped at all....

      I am not bull shitting you.

      Dad should have put in that deed of gift a provision that if indeed the City hit a good water supply used for the benefit of the People of the City, dad, and his two sons and a daughter, should each have claim on, say, 3000 gallons of water each, for each month.

      After all, we gave 'em the land.

      But, papa wasn't that far seeing, or too good hearted perhaps.

      The U.S. Supreme Court has never decided whether a president may be criminally prosecuted while in office, and the U.S. Constitution doesn’t give a direct answer.

      But the prevailing view is that a president can’t be indicted while in office, the New York Times reports. Presidents can be prosecuted, however, after they leave office or after impeachment, according to conventional wisdom.

      The issue is being debated anew amid reports that President Donald Trump asked then-FBI Director James Comey to shut down an investigation into former national security adviser Michael Flynn. Some have questioned whether the alleged request amounted to obstruction of justice.

      Article 1, Section 3 of the Constitution, doesn’t directly address the issue of prosecution in office. It reads: “Judgment in cases of impeachment shall not extend further than to removal from office, and disqualification to hold and enjoy any office of honor, trust or profit under the United States: but the party convicted shall nevertheless be liable and subject to indictment, trial, judgment and punishment, according to law.”

      Yale University law professor Akhil Reed Amar agrees with most scholars that a sitting president can’t be criminally prosecuted. He says the Constitution designates Congress as the court that tries sitting presidents.

      “If you’re going to undo a national election, the body that does that should have a national mandate,” Amar told the New York Times “Even a federal prosecution would follow only from an indictment from a grand jury sitting in one locality.”

      In a 1997 law review article, Amar argues that states can’t use their power to derail the functioning of the United States by prosecuting sitting presidents. And a federal prosecution would raise separation of powers problems, putting the executive branch at the mercy of the judiciary, he argued. Vox noted the article.

      Taking the other side is Hofstra University law professor Eric Freedman, who wrote a 1999 law review article that argued sitting presidents have no constitutional immunity from criminal prosecution.

      He argues that federal judges can be indicted, even though they are removed by impeachment. And, he says, giving sitting presidents immunity is inconsistent with the history, structure and philosophy of the U.S. government.

    "They (the special counsel) acknowledge the fact that they can't indict us," Giuliani told NBC News on Wednesday, indicating that the information had been conveyed to Trump's lawyers. "They know they don't have that power.

  22. Last week we discovered that Mueller was way ahead of us on the huge payments made to Trump's personal lawyer Michael Cohen for access to the president. We don't yet know what he's found out from cooperating witnesses, including Michael Flynn and Carter Page, that might point directly at the president.

    None of these threads signals Trump's removal from office. A conviction in the Senate, no matter what happens in the midterm, would require a good number of Republicans to turn against the president, which seems remote absent a smoking gun that proves grave criminal conduct.

    Tucker Carlson springs a racism trap on a progressive rising star

    David D. Burstein is one of the young rising stars of progressivism, as a glance at his personal website reveals. Praise from the likes of Howard Dean, Judy Woodruff of PBS, and David Gergen reveal him to be an anointed one, predicting that Millennials will bring a glorious new era in his book Fast Future: How the Millennial Generation is Shaping Our World.

    But last night, Burstein took on Tucker Carlson, defending a program at the University of Colorado, Colorado Springs, that offers credit for a program that focuses on what it alleges are traits of "dominant white culture" that include "superficiality" and "extreme exportation of labor and resources for profit." My impression is that he had never encountered someone willing to press him to go beyond his talking points.


    Carlson went for the jugular and kept pressing Burstein, who defended these negative generalizations about white people, if he was willing to make a negative generalization about any other demographic group in America. Apparently realizing he was trapped because of the utter taboo on P.C. white males criticizing nonwhites in any way, but admitting that only whites can be negatively stereotyped would discredit him and the program he was defending, Burstein emitted word clouds of rhetoric.

    Carlson's great virtue as an interviewer is his ability to remain polite, even cheery, yet insistent that the question be addressed. And to make the point that a refusal to answer is an answer itself.

    Random Forest is a supervised learning algorithm. Like you can already see from it’s name, it creates a forest and makes it somehow random. The „forest“ it builds, is an ensemble of Decision Trees, most of the time trained with the “bagging” method.     The paper buries more than one lede.

    If you’re a fading Baby Boomer, you’re faintly amused that the FBI code-named its Trump-Russia investigation “Crossfire Hurricane.” It’s an homage to the Rolling Stones golden oldie “Jumpin’ Jack Flash” — which, come to think of it, might just be a perfect handle for John Brennan, the former Obama CIA director whose specter hovers over each critical juncture of the case.

    The young’uns may not believe it, but back before it was known as “classic rock,” you couldn’t just play your crossfire hurricane on Spotify. You had to spin it. Fittingly, that is exactly what the New York Times has done in Wednesday’s blockbuster report on the origins of the Trump-Russia probe.

    The quick take on the 4,100-word opus is that the Gray Lady “buried the lede.” Fair enough: You have to dig pretty deep to find that the FBI ran “at least one government informant” against the Trump campaign — and to note that the Times learned this because “current and former officials” leaked to reporters the same classified information about which, just days ago, the Justice Department shrieked “Extortion!” when Congress asked about it.

    But that’s not even the most important of the buried ledes. What the Times story makes explicit, with studious understatement, is that the Obama administration used its counterintelligence powers to investigate the opposition party’s presidential campaign.

    That is, there was no criminal predicate to justify an investigation of any Trump-campaign official. So, the FBI did not open a criminal investigation. Instead, the bureau opened a counterintelligence investigation and hoped that evidence of crimes committed by Trump officials would emerge. But it is an abuse of power to use counterintelligence powers, including spying and electronic surveillance, to conduct what is actually a criminal investigation.

    The Times barely mentions the word counterintelligence in its saga. That’s not an accident. The paper is crafting the media-Democrat narrative. Here is how things are to be spun: The FBI was very public about the Clinton-emails investigation, even making disclosures about it on the eve of the election. Yet it kept the Trump-Russia investigation tightly under wraps, despite intelligence showing that the Kremlin was sabotaging the election for Trump’s benefit. This effectively destroyed Clinton’s candidacy and handed the presidency to Trump.

    It’s a gas, gas, gas!

    It’s also bunk. Just because the two FBI cases are both referred to as “investigations” does not make them the same kind of thing.

    The Clinton case was a criminal investigation that was predicated on a mountain of incriminating evidence. Mrs. Clinton does have one legitimate beef against the FBI: Then-director James Comey went public with some (but by no means all) of the proof against her. It is not proper for law-enforcement officials to publicize evidence from a criminal investigation unless formal charges are brought.

    In the scheme of things, though, this was a minor infraction. The scandal here is that Mrs. Clinton was not charged. She likes to blame Comey for her defeat; but she had a chance to win only because the Obama Justice Department and the FBI tanked the case against her — in exactly the manner President Obama encouraged them to do in public commentary.

    1. By contast, the Trump case is a counterintelligence investigation. Unlike criminal cases, counterintelligence matters are classified. If agents had made public disclosures about them, they would have been committing crimes and violating solemn agreements with foreign intelligence services — agreements without which those services would not share information that U.S. national-security officials need in order to protect our country.

      In the scheme of things, though, the problem is not that the FBI honored its confidentiality obligations in the Trump case while violating them in the Clinton case. The scandal is that the FBI, lacking the incriminating evidence needed to justify opening a criminal investigation of the Trump campaign, decided to open a counterintelligence investigation. With the blessing of the Obama White House, they took the powers that enable our government to spy on foreign adversaries and used them to spy on Americans — Americans who just happened to be their political adversaries.

      The Times averts its eyes from this point — although if a Republican administration tried this sort of thing on a Democratic candidate, it would be the only point.

      Like the Justice Department and the FBI, the paper is banking on Russia to muddy the waters. Obviously, Russia was trying to meddle in the election, mainly through cyber-espionage — hacking. There would, then, have been nothing inappropriate about the FBI’s opening up a counterintelligence investigation against Russia. Indeed, it would have been irresponsible not to do so. That’s what counterintelligence powers are for.

      But opening up a counterintelligence investigation against Russia is not the same thing as opening up a counterintelligence investigation against the Trump campaign.

      The media-Democrat complex has tried from the start to conflate these two things. That explains the desperation to convince the public that Putin wanted Trump to win. It explains the stress on contacts, no matter how slight, between Trump campaign figures and Russians. They are trying to fill a gaping void they hope you don’t notice: Even if Putin did want Trump to win, and even if Trump-campaign advisers did have contacts with Kremlin-tied figures, there is no evidence of participation by the Trump campaign in Russia’s espionage.

      At the height of the 2016 presidential race, the FBI collaborated with the CIA to probe an American political campaign.

      That is the proof that would have been needed to justify investigating Americans. Under federal law, to establish that an American is acting as an agent of a foreign power, the government must show that the American is purposefully engaging in clandestine activities on behalf of a foreign power, and that it is probable that these activities violate federal criminal law. (See FISA, Title 50, U.S. Code, Section 1801(b)(2), further explained in the last six paragraphs of my Dec. 17 column.)

      But of course, if the FBI had had that kind of evidence, they would not have had to open a counterintelligence investigation. They would not have had to use the Clinton campaign’s opposition research — the Steele dossier — to get FISA-court warrants. They would instead have opened a criminal investigation, just as they did on Clinton when there was evidence that she committed felonies.

      To the contrary, the bureau opened a counterintelligence investigation in the absence of any (a) incriminating evidence, or (b) evidence implicating the Trump campaign in Russian espionage. At the height of the 2016 presidential race, the FBI collaborated with the CIA to probe an American political campaign. They used foreign-intelligence surveillance and informants.

      That’s your crossfire hurricane.

    For the moment, this is just coming from one former reporter so I’d call this unconfirmed but intriguing. Paul Sperry is the former D.C. bureau chief for Investor’s Business Daily. He is also the author of a recent piece for Real Clear Investigations which stated that John Brennan selected Peter Strzok to help write the January 2017 Intelligence Community Assessment (ICA) and that Brennan had been dishonest about using the Steele Dossier in shaping the ICA. Today, Sperry published a couple of fairly explosive claims on Twitter which apparently come from the forthcoming DOJ Inspector General’s report:

    The Huber mentioned above is U.S. Attorney John W. Huber. Back in March, there was some pressure on AG Jeff Sessions to appoint a second special counsel to look into some decisions around the 2016 election. Sessions declined to appoint a new special counsel but announced that Huber would evaluate “certain issues” and that he would do so “in cooperation with the Inspector General.” So based on what we do know, i.e. Huber is working with IG Horowitz and the Horowitz report is expected soon, something like this could be breaking about now.

      Real Clear Investigations journalist Paul Sperry has noted that Inspector General Michael Horowitz found “reasonable grounds” for criminal prosecution and referred his findings to U.S. Attorney John Huber for possible criminal prosecution.

      Hopefully, this does not come as a surprise to CTH readers. Remember, the IG draft report has just been sent to the principals for review. Generally speaking IG draft reviews take around two weeks. The final IG report is on target for release by the end of May.

      While the terms “reasonable grounds” and “criminal prosecution” gain additional emphasis against the draft submission, months ago it was transparently obvious OIG Michael Horowitz discovered criminal conduct and submitted his request. AG Jeff Sessions informed everyone of U.S. Attorney John Huber in March.


      If IG Horowitz did not discover reasonable evidence of criminal conduct there would not be a U.S. Attorney (Huber) paralleling his investigation since late last year. U.S. Attorney John Huber was assigned to assist Horowitz at least eight months ago. It wasn’t until March of this year when AG Jeff Sessions, quietly made the acknowledgement.

      The evidence of a U.S. Attorney working with Horowitz was initially evidenced when it became obvious that Lisa Page, Peter Strzok, James Baker and Bruce Ohr were cooperating with the investigation. Each of these individuals is clearly outlined as engaging in conduct that exposed them to legal risk. The IG cannot coordinate terms of cooperation surrounding unlawful conduct. That was the first indication a U.S. attorney was assisting. That indication was more than six months ago.

      “They are sat down, told to not do anything, say anything or discuss anything UNTIL they get an attorney. At which time, the attorney is handed a letter from the investigating unit. That letter says in essence, this is how screwed you are. If you want to be less screwed you will sign this letter of cooperation and assist us. When we don’t need you, you sit there. When we do we will call you and you will provide what we need. Any deviation from this agreement lands you in jail for the full term.” (Link to Prior)

      The fact that U.S. Attorney John Huber exists is evidence in-and-of-itself that criminal conduct was discovered by IG Horowitz. It should not come as a surprise to hear news today about this. Clearly U.S. Attorney John Huber has been reviewing evidence and conducting his own investigation for more than six months.

      The school where I taught was slowly degenerating into the inmates taking over the asylum. I retired a little early because I couldn't deal with the jerks who were entering my classroom any more. Whether you are black, white, or brown, if you are essentially raised as a feral child without any serious parental direction, this is the behavior that results.

      The "students" who are entering the school system are becoming increasingly violent and hostile toward their teachers. Many of them have qualified for special education services so they are almost impossible to remove from your classroom. They are there to socialize, use the WiFi, eat, and keep their parents out of trouble for enabling their truancy.

      The Obama policies of keeping "kids" out of the "prison pipeline" has taken hold across the country with discipline policies that are an absolute joke. Increasingly you will see fewer and fewer highly qualified teachers coming into the profession and the inner city schools will be scraping the bottom of the barrel to find warm bodies to "teach" their pupils.

      Many teachers who are now in the profession in districts like this are deciding to find another way to make a living and are leaving the profession far short of retirement. Having the summers off simply isn't worth sleepless nights and going to work with a knot in your stomach every day.

I agree. I also know that PAST behavior is not a reliable predictor of which side a person or country is on in this current battle.     5. Most of the traditional news media seems to have played an active role in this effort against Trump. Given the effort to overthrow POTUS and undermine the legitimacy of our basic institutions, I think there is certainly room to consider extraordinary measures. The people/organizations involved in the coup are hostile and should be treated in an appropriate manner. To be sure, we do not have channels of communicating the nature of the crisis to the public – particularly with hostile media outlets propagandizing the general population. Let’s face it – the traditional news media despises most of the population and actively works against the domestic and international interests of the Republic. So POTUS needs to find a way forward that helps to resolve the problem (hostile news media) without undermining our commitment to expressive rights. The reckoning is near and we should all remember Trump’s declaration that the news media is the enemy of the American people. He was not kidding and we should expect appropriate actions in the near term. MAGA!
