What did President Obama know and when did he know it?

For a smart man, President Obama professes to know very little about a great number of things going on in his administration.
On Sunday night, the Wall Street Journal reported that he didn’t learn until this summer that the National Security Agency had been bugging the phones of German Chancellor Angela Merkel and other world leaders for nearly five years.
That followed by a few days a claim by Health and Human Services Secretary Kathleen Sebelius that Obama didn’t know about problems with the HealthCare.gov Web site before the rest of the world learned of them after the Oct. 1 launch.
It stretches credulity to think that the United States was spying on world leaders without the president’s knowledge, or that he was blissfully unaware of huge technical problems that threatened to undermine his main legislative achievement. But on issues including the IRS targeting flap and the Justice Department’s use of subpoenas against reporters, White House officials have frequently given a variation on this theme.
Question: What did Obama know and when did he know it?
Answer: Not much, and about a minute ago.
The Associated Press’s Josh Lederman led off Monday’s White House briefing with an obvious question: “Was the president kept out of the loop about what the NSA was doing?”
“I am not going to get into details of internal discussions,” press secretary Jay Carney replied, repeating previous promises that “we do not and will not monitor the chancellor’s communications.” This formulation conspicuously omits the phrase “did not.”
CNN’s Jim Acosta cited the HealthCare.gov rollout and the IRS targeting, which Obama said he learned about through news reports. “Is there a concern,” Acosta asked, “that the president is being kept in the dark on some of these issues?”
Carney told Acosta he had “conflated a bunch of very disparate issues.”
“Republican critics,” Acosta said, “are making the case, though, that the president appears to be in the dark about some pretty significant stories that are swirling around this White House.”
“Well, Republican critics say a lot of things, Jim,” Carney replied icily.
That’s true. But in this case, the Republicans understated the number of issues on which the president has claimed to be in the dark. A compilation by the Republican National Committee titled “The Bystander President” cited the NSA spying on Merkel, the Obamacare rollout and an investigation of the IRS’s targeting of political groups (the White House counsel knew of the inquiry but said she didn’t inform Obama). The RNC also mentioned the failure of clean-energy company Solyndra, which had received government funding (Carney had said Obama read about it in “news accounts”), and the attempts to go after reporters’ phone and e-mail records (which the president also found out about from reading the news, Carney said).
The RNC didn’t mention that Obama had allegedly known nothing about an FBI investigation of an affair involving David Petraeus that led him to resign as CIA director. Neither did it mention two other claims that conservatives often question: Obama’s ignorance of a guns-on-the-border sting operation called “Fast and Furious” that went awry, and his unawareness of requests for additional diplomatic security in Libya before a U.S. outpost in Benghazi was attacked.
There’s no reason Obama should have known about Fast and Furious or diplomatic security requests. But how could he not know his spies were bugging the German chancellor?
“Is it believable that the president would not know about surveillance of the head of state of a close American ally?” ABC News’s Jon Karl asked Carney. “Does that sound plausible to you?”
This finally provoked a hint from Carney that Obama did, in fact, know that the NSA was bugging Merkel. “The Wall Street Journal probably doesn’t appreciate the suggestion that their story is wrong,” he said, referring to a report that said Obama learned of the activity in the summer, “but I would say simply that we’re not going to comment on specific activities reported in the press,” he said.
Another hint came from Carney’s assurance that “the president has full confidence in General [Keith] Alexander and the leadership at the NSA.” Obama probably wouldn’t have such confidence if that leadership had kept him in the dark about something as consequential as the bugging of world leaders’ phones.
On one level, it would be reassuring — and much more credible — if the White House admitted that Obama is more in the loop than he has let on. On another level, it would be disconcerting: Is it better that he didn’t know about his administration’s missteps — or that he knew about them and didn’t stop them?

      The idea that he was not not, while floating the "Birth Certificate" meme, that is just childish.
      But if you float the "Birth Certificate", that goes hand in hand with the CIA involvement.

      There is no other way the "Birth Certificate" could have been fabricated, no other way the mother could smuggle a baby into Hawaii.

    The journalist who worked with US whistleblower Edward Snowden has urged Germany to offer protection to the former intelligence operative. Meanwhile, Berlin is to debate claims the US spied on Chancellor Angela Merkel.

    In an interview with German television on Monday, Brazil-based Glen Greenwald said Germany should offer asylum to former US intelligence operative Edward Snowden, who is currently being granted temporary asylum in Russia.
    Through the British newspaper The Guardian, US journalist Greenwald uncovered details of the National Security Agency (NSA) surveillance program early this year based on leaks from Snowden, a former NSA contractor.
    In an interview with German public broadcaster ARD, Greenwald said the extent of spying activity of the NSA - including the eavesdropping on Chancellor Angela Merkel's phone - would not be known without information made available by Snowden.
    "Germany is precisely one of the countries that has most benefited from these revelations, from the start," said Greenwald.

    Obama's Clueless Shtick Wearing Thin

    White House officials are insisting that the president didn't know that his National Security Agency was bugging German Chancellor Angela Merkel's phone. However, according to a report in German-language newspaper Bild am Sonntag, President Obama "personally authorized the monitoring of Angela Merkel's phone three years ago."

    So here we go again. What did Obama know, and when did he know it? The Merkel-Obama scandal is now supplanting the ObamaCare IT fiasco. Before the health care website flop, there were Benghazi, Syria, and Fast and Furious. What about the IRS targeting conservative groups and the Tea Party? No one bothered to tell Obama about that little powder keg, either. "I can assure you that I certainly did not know anything about the [inspector general's] report beforehand," said Obama.
    Over the last five years Americans have heard the president and his various agency heads deny his involvement in any high-level programs.

    But Obama's hands-off approach contradicts what mainstream journalists from the New York Times and the Washington Post have observed about the ruling cabal in D.C. Obama's media friends complained about the administration's obsessive need to micromanage and survey everything going on around them, calling the group hypersensitive and "control freaks." So how can Obama and company claim ignorance while acting like autocratic overlords?

    "This is the most closed, control freak administration I've ever covered," said David E. Sanger, veteran chief Washington correspondent of The New York Times. ...

    Washington Post national security reporter Dana Priest ... : "... I'm even afraid to tell officials what I want to talk about because it's all going into one giant computer." ...

    "Sometimes their levels of sensitivity amaze me-about something on Twitter or a headline on our website," said Washington Post Managing Editor Kevin Merida.

    If the Obama administration fits the definition of control freaks, as Sanger contends, there is a slim-to-none chance Obama didn't know exactly what was going on at the NSA, the IRS, the ATF, the CIA, and the FBI, to name a few

    The President and his mouthpiece Jay Carney are wearing out the "I didn't know, we can't comment because of the ongoing investigation", excuses.

    Ignorance is allowed to be the best defense. And the White House press corps apparently feels his ignorance. They are all ignorant together. We will now field questions on gay marriage and immigration.

    He did not know of Merkel phone taps. But he knows how the putts break at Congressional. The leader of the free world didn't know that the government he heads was monitoring the private communications of the leaders of other free world nations.
    Frankly, I would be surprised if we weren't monitoring or attempting to monitor everything we can get our hands/ ears on. I always had issue with other countries attempting to spy on us, but it is a game, and fair at that. What is distasteful is the spying on us by countries to which we give large sums of "aid". Perhaps the gifting should be conditional. but I digress.

    Now, who ordered or didn't order or knew of the Benghazi attack? What was the question again? Who denied additional security requests, altered the talking points, etc. ? Why no eye witness public testimony? Inquiring minds want to know. We will get to the bottom of this....right?

    Didn't know of Reverend Wright's diatribes and their content? For 20 years and approximately 400 sittings before the good reverend, the smartest guy in the zip code just didn't hear or understand what was being said.

    For allegedly possessing a remarkable intellect and intelligence, he seems content to be kept under informed and out of the sunlight of information. But isn't his obligation of office to know what transpires, what is occurring about him and under him?
    Is he dangerously uninformed or remarkably naïve?

    If the President learns from watching the news, perhaps he could learn a little earlier in the cycle if his press corps lap dogs would just give him a heads up before it gets to an evening news anchor.

    This is a dog leg left as I remember.

    NBC News is reporting that the majority of those who purchase their insurance on the individual market will see their policies cancelled, and that the Obama administration has known for at least three years that would happen.

    A story just published on the network’s web site says that although President Obama assured Americans that they could keep their health policies if they so desired, 50% to 75% of 14 million Americans under individual policies will get a cancellation letter because their plan is not in compliance with new rules governing coverage.

    Further, many are experiencing sticker shock over the premiums that will be charged on their new policies. The story goes on to quote a number of insurance experts, who say the 50% to 75% figure is accurate. That puts the number of those forced to shift to new policies at roughly 7 million to 10.5 million.

    The law as passed in March 2010 was supposed to grandfather in existing policies, even if they weren’t in compliance with the law. In July of that year, though, the Department of Health and Human Services rewrote some of the regulations, saying that if any significant part of the policy was altered, it could not be grandfathered.

    In response, the White House doesn’t dispute the findings, but it is quoted by the story as saying that individual policy holders will, for the most part, receive better coverage that is more affordable, thanks to subsidies. They add there is no chance the policy can be cancelled due to pre-existing conditions, which can often be the case with current health plans.

    The NSA is J. Edgar Hoover in Bizarro-land.

    Don't have time to look it up but paraphrasing one of the previous NSA directors, "My wet dream is to have a file on every person on earth."

    You would have to be a fool to think opponents like Amash and Wyden aren't being tapped.

    Dirty tricks? If you've got the info why not use it?

    The intelligence committees in both House and Senate have been in the pocket of the NSA, FBI, CIA, etc. They have been providing more cheerleading and enabling than oversight. One wonders why.

    3. The Drudge Report continued linking back to preeminent birther website World Net Daily, this time to lend credence to the theory that President Obama took a leave of absence during his time at Columbia Law School so he could serve as a special agent for the CIA in Pakistan.

      The WND article, written by washed up fiction author Jerome Corsi, alleges that there is a discrepancy in Columbia University’s records which “casts doubt” on Obama’s well-documented two year tenure at the New York school. He then inexplicably suggests that the reason for the “missing year” is that Obama spent it in Pakistan as an agent for the Central Intelligence Agency:

  14. Does anyone remember when Viet Nam became Vietnam. I always write it the way that it was on the type written orders posted on the orderly room bulletin board, “Viet Nam”. I remembered a Forward Air Controller named McAllister, who got killed and did a Google search on him and found this from Time. Sure enough, it was Viet Nam:

  17. Iran Offers UN Monitors Measures to Boost Trust in Atomic Work

    Iran and United Nations nuclear monitors came closer to compromising on measures intended to build international trust that the Persian Gulf nation isn’t harboring a clandestine nuclear-weapons program.

    International Atomic Energy Agency officials will travel to Tehran for a Nov. 11 meeting, where both sides will attempt to finalize an accord, chief inspector Tero Varjoranta said today in a joint statement in Vienna with Iranian envoy Reza Najafi.

    “Iran presented a new proposal with practical measures as a constructive contribution to strengthen our cooperation", Varjoranta said.
    The Tehran meeting will be used “to take this cooperation forward,” he said.

    The IAEA talks, aimed at winning wider access to people and places in Iran, are part of a flurry of diplomatic activity surrounding the country’s nuclear work. Concurrent negotiations between Iran and the so-called P5+1 powers -- the U.S., France, the U.K., Russia, China and Germany -- are seeking a settlement to a conflict which has raised the specter of war for a decade.

      The relatively upbeat announcement by Iran and the International Atomic Energy Agency may further buoy hopes for a negotiated solution to the international standoff over Tehran's nuclear ambitions after the June election of moderate President Hassan Rouhani, who is seeking to reduce tension with the West.

      The U.N. agency wants to resume an investigation, long stymied by Iranian non-cooperation, into what it calls the "possible military dimensions" of the Islamic Republic's nuclear program.
      Tehran says it is enriching uranium solely for electricity generation and medical treatments.

  18. Iran sentences activist actress to prison

    TEHRAN, Iran (AP) — An Iranian actress known for her political activism in support of the country's reformists has been sentenced to 18 months in prison after facing security charges, newspapers reported Tuesday.

    The case over the 24-year-old actress, Pegah Ahangarani, points to the internal, and sometimes conflicting, centers of power in Iran as calls for greater openness by new President Hassan Rouhani have angered Iran's more conservative judiciary.

    The judiciary is controlled by the country's ruling clerics, headed by Supreme Leader Ayatollah Ali Khamenei, who approved some of Rouhani's main international initiatives, such as outreach to Washington despite opposition from some hard-line groups. But Khamenei and his inner circle appear cautious on fast-paced domestic reforms that could further anger Rouhani's opponents.

    Ahangarani, who has appeared in about 20 films, has been detained twice since the protests in 2009 over the disputed re-election of then-President Mahmoud Ahmadinejad, but she was released without charges. Recently, she has been banned from traveling abroad.

  19. Iran outlines plan to win back Western oil interest:

    (Reuters) - Iran is planning to offer international companies more lucrative contracts to attract at least $100 billion worth of investment in its oilfields over the next three years, the Financial Times reported on Monday.

    An adviser to Iran's oil minister, Mehdi Hosseini, was quoted in the Financial Times article as saying the Islamic republic would scrap its current system of "buyback" contracts, which do not allow foreign companies to book reserves or take equity stakes in Iranian projects.

    According to the article, Hosseini said a new "win-win" type of contract, details of which are expected to be announced in London next March, was in the works and leading companies could benefit, "whether American or European".

    Iran said last week that it would reach out to old oil buyers and was ready to cut prices if Western sanctions against it were eased, promising a battle for market share in a world less hungry for oil than when sanctions were imposed.

    Iran's crude exports were reduced by more than half after the European Union and United States tightened sanctions in mid-2012 ...

      It is hard for anyone to get a building permit. Palestinians going through the usual process are granted building permits.

      Furthermore, building permits or not, Palestinians are not prevented from visiting their holy sites. Since Abbas has said the the PA would be free of Jews, I take it that the same decency does not apply. And by the way, why isn't anyone complaining about a Jewish free Palestinian policy - rather hypocritical, wouldn't you say.

      The BBC’s correction is a welcome development in challenging the discourse that Israel is the Middle East’s “only democracy.” Indeed, the report itself describes a reality that would be greeted with outrage in the UK or USA:

      Dany Gliksberg of Ayalim says a Jewish majority in the Negev is essential to preserve the democratic nature of the state. Otherwise, he says, “we will be a minority ruling a majority of non-Jews.”
      His organisation is getting increasing political backing from the government, with two visits from Prime Minister Binyamin Netanyahu in recent weeks.

      Thus Israel’s systematic racism is not only enshrined in the law — it is manifested in official government support for groups openly promoting an agenda equivalent to that of European far-right fringe groups. Hopefully the reality of Israel’s so-called democracy will be increasingly reported by the mainstream media.

      Contrary to the contention made by the IDF Spokesman's Office, a report by the No Legal Frontiers organization that is summarized in today's Haaretz says the military juvenile court that has been established has hardly improved the defense of the rights of minors at all. The improper act of throwing stones is not only used in the territories. This type of violent conduct does indeed endanger life, with the potential to kill, seriously injure or to paralyze, particularly if it involves a heavy rock thrown from a tall building or a bridge, or from a speeding car.

      If someone Jewish throws a stone, the injury inflicted is as bad as if it is thrown by an Arab. The need to punish and deter does not disappear when the scene shifts to the Israeli side of the Green Line.

      Israel's pretention to be a country in which equality under the law prevails appears ridiculous in the face of the other justice system that applies to juveniles that are not Palestinian. There, every possible reasonable argument is presented in support of forgiving young people for their passing caprices and to allow them to enlist in the IDF and avoid a criminal record, in the spirit of compassion.

      The violent Israeli youth who attacked soldiers and policemen who had been sent at the government's behest to Gaza and the northern West Bank to evacuate settlements six years ago did not have to wait long before their sentences were mitigated. The result is glaring in the cases of the current assaults on the IDF's West Bank division commander, Brig. Gen. Nitzan Alon, and Deputy State Prosecutor Shai Nitzan.

  25. South Africa: Nelson Mandela coup plotters sentenced

    The ringleader of a white supremacist plot to assassinate Nelson Mandela and drive black people out of South Africa has been sentenced to 35 years in jail.

    Former university lecturer Mike du Toit was convicted last year of treason for his leadership role in the plot, after a trial lasting nine years.

    Twenty other members of his white supremacist militia Boeremag were also jailed for between five and 35 years.

    In 2002 it attempted to overthrow the governing African National Congress.

    In July 2012 Du Toit, a history lecturer with a master's degree in philosophy, was convicted of being behind nine bombings in Johannesburg's Soweto township in 2002, killing one person.

    He was also found guilty of authoring a blueprint for revolution intended to evict black people from most of South Africa and establish a racially "pure" nation by killing anyone who got in the way.

    Du Toit was the first person to be convicted of treason in South Africa since white minority rule ended in 1994.

    Mr Mandela spent 27 years in prison for his fight against apartheid before becoming the country's first democratically elected president in 1994.

    Israel will not recognize an Israeli nationality while it seeks to maintain Jewishness at all costs


    When a border official opens an Israeli passport for inspection, he or she sees the passport holder’s nationality stated as “Israeli.” And yet inside Israel, no state official, government agency or court recognizes the existence of an “Israeli” national.

    This month the highest court in the land, Israel’s Supreme Court, explicitly affirmed that it could not uphold an Israeli nationality. Instead, the judges ruled, citizenship and nationality in Israel should be considered entirely separate categories, as they have been since Israel’s founding in 1948. All Israelis have Israeli citizenship, but none enjoys Israeli nationality.

    This fiction of Israeli nationality, contained in Israeli passports and presented to the international community is not simply a piece of legal eccentricity on Israel’s part. It is the keystone of Israel’s existence as a Jewish state—and much depends on it.

    From this simple deception, Israel has been able to gerrymander its population by excluding Palestinian refugees from their land and homes while allowing millions of Jews to immigrate. And the same deception has served to veil a system of segregation in legal rights—a form of apartheid—between Israeli Jews and the country’s Palestinian minority, who comprise a fifth of the total population.

    The need to maintain the state’s Jewishness at all costs, meanwhile, is emerging as the chief obstacle erected by Israel to prevent a peace agreement with the Palestinians from being reached.

    So how does this Israeli magician’s trick work? Perversely, nationality in Israel is based not on a shared civic identity, as it is in most places, but on one’s ethnic identity. That means for the overwhelming majority of Israeli citizens, their nationality falls into one of two categories—Jewish or Arab. That is why Israel must lie on its passports: no border official would allow in a person bearing a passport that declared simply that they were “Arab” or “Jewish.”

    The peculiarity of this classification system is further underlined by its anomalies. What does Israel do with the small number of non-Jews who marry an Israeli and then choose to naturalize? The answer is that the state can select from more than 130 nationalities. ‘Misfits’—those who are neither Jewish nor Arab—are typically assigned the nationality they held before they naturalized, such as French, British, American, Georgian, Ukrainian, and so on.

    A great deal is at stake in this arcane system, which is why since 1948 the Israeli Supreme Court has on three separate occasions ruled against groups of Israeli citizens who have demanded the right to be identified as Israeli nationals.

    This month, faced with a petition from a group called “I am Israeli,” the judges argued that recognizing such a nationality would threaten the state’s foundational principles. In the words of Justice Hanan Melcer, uniting Israeli citizenship and nationality would run “against both the Jewish nature and the democratic nature of the state.”

    Anita Shapira, a professor emeritus of Jewish history at Tel Aviv University, concurred, saying that the petitioners were making a “revolutionary” demand.

    However, Aeyal Gross, a Tel Aviv law professor, took a different view. The ruling, he wrote in the Haaretz newspaper, “will continue to obscure the possibility of having real democracy in Israel.”

      Mr. Ornan et al did not persuade the Court to change this.

      To say that something is discriminatory, without so much as a single example, might not have seemed compelling to the Court. Israel has its fair share of Al Sharptons and Jesse Jacksons.

      At the moment, the majority of Israelis agree with the Court: they are Jews, Arabs, etc. etc, etc. Until that changes the status quo will prevail.

      It being no small matter, recall that Mr. Netanyahu insists that Abbas must agree that Israel is a Jewish state before any peace agreement.

  29. Nazareth, Israel - A court decision this month that rejected Israelis' right to a shared nationality has highlighted serious problems caused by Israel's self-definition as a Jewish state, say lawyers and human rights activists.

    A group of 21 Israelis had appealed to the Supreme Court to demand the state recognise their wish to be classified as "Israeli nationals".

    Since Israel's founding in 1948, authorities have refused to recognise such a nationality, instead classifying Israelis according to the ethnic group to which each belongs. The overwhelming majority are registered as either "Jewish" or "Arab" nationals, though there are more than 130 such categories in total.

    Critics say the system, while seemingly a technical matter, has far-reaching effects. The citizenship laws, they say, undergird a system of systematic discrimination against the one-fifth of Israel's population who are non-Jews - most of them belonging to Israel's Palestinian minority.

    Some observers also fear that the court ruling, which effectively upheld Israel's definition as a Jewish state, will strengthen the aversion of Israel's right-wing government to resolve the Israeli-Palestinian conflict.

    Israeli Prime Minister Benjamin Netanyahu has repeatedly insisted that Mahmoud Abbas and the Palestinian Authority recognise Israel as a Jewish state as a condition for reaching a peace agreement.

    The case was brought to court by the "I am an Israeli" movement, led by Uzi Ornan, a retired linguist from northern Israel. The group, which includes both Jewish and Palestinian citizens of Israel, argued that they should be allowed to change their nationality to "Israeli".

    "This ruling is very dangerous," said Ornan.
    "It allows Israel to continue being a very peculiar country indeed, one that refuses to recognise the nationality of its own people. I don't know of another country that does such a thing. It is entirely anti-democratic."

      Acting Assistant Attorney General Mythili Raman of the Justice Department’s Criminal Division said Renzi “abused the power and the corresponding trust that come with being a member of Congress by putting his own financial interests over the interests of the citizens.”

      “He fleeced his own insurance company to fund his run for Congress and then exploited his position for personal gain,” Raman said.

      Renzi’s sentencing caps criminal proceedings that dragged on for more than five years.

      In June, after a 24-day trial, he was found guilty on two sets of charges. In one scheme, prosecutors said, he embezzled client funds from his southern Arizona insurance brokerage, funneled the money into his first election campaign and sought to cover up the crime.

      In the second conspiracy, Renzi was charged with committing extortion while trying to orchestrate a swap of U.S. government land for an alfalfa farm near Sierra Vista that belonged to a business partner who owed him money.

      A deal ultimately was consummated, and Renzi received payment of a $733,000 debt from his associate, James Sandlin, 62, who was sentenced Monday to 18 months in prison.

      Assistant U.S. Attorney Gary Restaino said the outcome verifies that, no matter how long it takes, “justice will be served.”

      Renzi, now a Virginia resident, was a real-estate developer, vineyard owner, insurance broker and attorney. In Congress, he gained the reputation of a conservative Roman Catholic with strong views against abortion. He is married with 12 children.

    Anecdotal evidence has long supported the hypothesis that the fair sex is also the "do-a-bunch-of-things-at-the-same-time" sex. And now a study out of the U.K. helps to support the idea women are better at multitasking than men.

    In a set of two experiments, psychologists at the University of Hertfordshire, the University of Glasgow and the University of Leeds pitted men against women to see if they could lend some scientific credibility to that commonly held belief that women are better than men at multitasking.

    4. If you were computing in the 80s and early 90s, you might remember that PCs ran DOS, and gave you a C:\ prompt, and you could only run one thing at a time. Word Perfect. Lotus 1,2,3. Laser focus on one task, like men. Meanwhile the big iron ran Unix, and managed hundreds of accounts at the same time, and on each terminal there might be several tasks running in the background, perhaps fetching email, perhaps compiling some code, while the user was sitting on Emacs doing something else. Womenfolk. And this basic fact of brain wiring explains why I can be shouting at my husband while he's watching something on television and he honestly can't hear me. Fortunately for our marriage I understand this. And it probably explains why men write all the symophonies, or get all the Nobel Prizes in science, or always invade the Low Countries.

  36. How the Court Case Against Obamacare Subsidies Stacks Up

    Last week, the most important case that you've never heard of survived its first legal hurdle. Judge Paul Friedman of the United States District Court for the District of Columbia ruled that plaintiffs had standing to advance a broadside attack on the subsidy system at the heart of the Patient Protection and Affordable Care Act, colloquially known as Obamacare.

    Although the Clinton appointee refused the plaintiffs’ requests to temporarily enjoin -- that is, block -- the subsidies, he did so because there would be no harm to delaying an injunction until the conclusion of the case; he did not directly speak to the merits of the underlying claim (though he did note that both sides had made, in his view, credible cases). Friedman promised to rule by Feb. 15, and if he does enjoin the subsidies to the federal exchanges -- or if any judge in three other pending cases does so -- the law might well prove unworkable.

    The challenge revolves around three provisions in the Affordable Care Act. Section 1311 of the law establishes state insurance exchanges. It provides, in part, that “[e]ach State shall . . . establish an American Health Benefit Exchange . . . for the State.”

    Of course, Congress can’t actually force states to take such a step, as that would be an unconstitutional commandeering of state governments. While the administration believed that all states would eventually create these marketplaces, the ACA nevertheless provides a backstop in case that didn’t happen: Section 1321 specifies that “the Secretary [of Health and Human Services] shall . . . establish and operate such Exchange within the State and the Secretary shall take such actions as are necessary to implement such other requirements.”

    A related provision deals with the calculation and payment of insurance subsidies. To cushion the blow of the individual mandate to purchase coverage and pay for associated increased costs, the ACA includes “premium assistance” for lower-income taxpayers. These subsidies are available to people whose plans “were enrolled in through an Exchange established by the State under section 1311 of the Patient Protection and Affordable Care Act.”

    If you’ve been reading carefully, you can see the problem. By its plain text, the ACA only provides for subsidies for people enrolled in an exchange that was (a) established by the state and (b) established under section 1311. (In case you were wondering, the law defines “State” as “each of the 50 States and the District of Columbia.”) This is the argument, in a nutshell, of those bringing the lawsuit. If you live in, say, Oklahoma, which didn’t set up an exchange, the ACA doesn’t appear to offer a mechanism for you to receive any subsidies.

    If you’re an opponent of Obamacare, you’re probably nodding along vigorously. This case is made all the stronger because we’re talking about a congressional appropriation, and appropriations have to be expressly made by Congress under the Constitution.

    But if you’re a supporter of Obamacare, you’re probably saying, “Oh, come on! It’s pretty clear Congress wanted everyone to get the subsidies.” That, in a nutshell, is the government’s response. The IRS therefore set forth a rule that extended the subsidies to those enrolled in a “State Exchange, regional Exchange, subsidiary Exchange, [or] a Federally-facilitated Exchange.”

      Washington— The U.S. Treasury has booked a $9.7 billion loss on its $49.5 billion bailout of General Motors Co. on the sale of nearly all of its shares it received as part of its $49.5 billion bailout.

      In a quarterly report to Congress Tuesday, the Special Inspector General overseeing the $700 billion Troubled Asset Relief Program bailout fund disclosed that the Treasury had realized a significant loss on its sale of most of its 60.8 percent stake in GM. Through Sept. 30, Treasury sold 811 million shares of the 912 million shares it received in the automaker as part of its 2009 bankruptcy restructuring.

      The taxpayers’ ownership stake in the Detroit-based automaker — swapped for more than $40 billion in loans, was initially 60.8 percent, but is now down to about 7 percent, the Treasury said. “Because the common stock sales have all taken place below Treasury’s break even price, Treasury has so far booked a loss of $9.7 billion on the sales,” the report said.

      Treasury would need to get $147.95 on its remaining shares to break even. That’s not going to happen: GM’s stock closed Wednesday at $35.80, up $0.21, or 1 percent. At current trading prices, the government’s remaining stake is worth about $3.6 billion. At current stock prices, taxpayers would lose about $10 billion on the bailout when all the stock is unloaded.

      Earlier this month, Treasury reported it sold $570.1 million in General Motors Co. stock in September, as it looks to complete its exit from the Detroit automaker in the coming six months. The Treasury says it has recouped $36 billion of its $49.5 billion bailout in the Detroit automaker. The government began selling off its remaining 101.3 million shares in GM on Sept. 26, as part of its third written trading plan. The government didn’t disclose precisely how many shares it sold in the final days of September, but at recent trading levels could exit as early as January.

      The report also says that SIG TARP has worked to uncover fraud in the bailout program. To date, 154 people have been charged and 65 individuals have been sentenced to prison for their crimes investigated by SIGTARP and its law enforcement partners. Nearly all have involved bailouts to banks. None have involved the auto bailouts.

      The report also found that 19 states in the “Hardest Hit Fund” have spend just 22 percent, or $1.7 billion, of the $7.6 billion in TARP funds that Treasury allocated for the program to provide assistance to homeowners struggling to pay mortgages — three and a half years after the program began.

      Michigan is one of eight states in the program that have spent less than 22 percent of the funds allotted to them for assisting homeowners. The state has spent 17 percent of the $498.6 million allocated as of June 30 — and has reduced the number of homeowners it predicts it will aid -- to up to 11,477, down from an initial estimate in 2010 of as many as 49,442, the report said. With Treasury approval, Michigan is using some of the funds to tear down blighted buildings.

      A second program, the Home Affordable Modification Program, designed to encourage loan services and investors to reduce monthly payments to homeowners at risk of imminent default, has spend $5.4 billion of $22.7 billion allocated.

      In Michigan, 36,801 permanent loan modifications have been made under the “HAMP” program — and 25,802 are paying on time. Of the total, 28 percent, or 10,151, have re-defaulted on their mortgages

    It’s just one tweet, but the sheer mendacity requires its own post. With the media finally in “now it can be told” mode since Obamacare passed and President Obama was reelected, pretty much everyone is admitting what all of us knew four years ago— that no, not everyone would be able to keep their plans if they liked their plans. And, yes, the Obama administration knew it just as sure as its critics did.

    It was a lie and an obvious one, but the administration, much of the media, and Obamacare supporters happily acted as if it were true and happily smeared those who suggested otherwise. Tonight, the president’s right-hand woman tries the lie again, even as it’s demonstrably unraveling before the nation’s eyes.


    Let’s try to walk through this inanity. There’s nothing in Obamacare that forces people out of their health plans. Instead, Jarrett asserts, insurance companies are just deciding to change their plans, throwing people off their current coverage.

    She leaves out the part where Obamacare legally requires all health insurance plans to include a certain number of benefits that was above and beyond what many more, ahem, affordable plans offered, thereby making certain plans illegal. Many of those plans were plans that people liked and were assured they could keep. Obamacare offered a “grandfathering” clause, which the administration later eviscerated after it had served its political purpose, ensuring even more people would lose their current coverage. So, no change is required by you under Obamacare unless your insurance company goes and changes your existing plan to comply with Obamacare.

  40. A 13-year-old girl has dug herself out of a muddy grave after being raped by two men who then buried her alive in Pakistan.

    The teen was abducted from her local village in the Punjab province while she was walking to Koran lessons.

    Her father Siddique Mughal told police his daughter had been taken, but they refused to cooperate, Outlook India reported.
    The men took the young girl to an isolated place and raped her and then buried her alive as they believed she died during the brutal attack.

    But the girl managed to dig her way out the muddy grave and caught the attention of passers-by who helped her to a local medical center.

    After local police refused to investigate, the Lahore High Court Chief Justice’s Complaint Cell formally directed them to arrest the girl’s attackers and complete a report on the incident without delay.

    A sessions judge for the local Toba Tek Singh region has also been asked to look into the matter.

    Child rape remains a problem in Pakistan where local activist group Sahil said cultural myths persist such as HIV positive men believing they can be cured through sex with a virgin.

    Statistic show cases of child rape have risen from 668 in 2002 to 2,788 last year, according to the International Business Times.
    “We still think these statistics are just a fraction of what’s going on,” Sanihl’s executive director Manizeh Bano told the International Business Times.

      The victim may not know that help is available or who they can talk to
      The victim may be afraid of what will happen if they tell someone
      The abuser may have threatened the victim
      The victim may care about the abuser and be afraid of what will happen to the abuser if they tell
      The victim may be afraid of what will happen to them if they tell
      The victim may also be concerned about how many people will react when they hear about the abuse
      They may be afraid that no one will believe them or that the person they confide in will tell the abuser
      The victim may be afraid that people will accuse them of having done something wrong

    Auto Industry: The auto industry rescue was started by George Bush. Obama deserves credit for finishing it.

    Economy: In 2008, it was the Bush administration that passed TARP. In 2009, it was Obama who passed the stimulus program which was pretty much impotent in terms of creating jobs and improving the economy. And that's just for starters. No sense going into all the negatives we have seen during Obama's 'recovery', the unemployed, the underemployed, the drop in the percentage of employed. One telling point, there are still 2.6 million fewer jobs in the economy than there were prior to the 2008 recession.

    If that's considered 'saving the economy', lord help us. Obama has ignored the jobs issue for his entire presidency.

    Iraq: All Obama did was follow the timetable set by the Status of Forces Agreement signed by Bush and the Iraqis in 2008. To do otherwise would have violated the agreement we had with the government we helped set up.

    Cut the deficit by half: One has to ask how long you can keep running deficits of $1.5 trillion a year. A big part of the reduction is due to sequestration, a perfect example of dumb shits not doing their job and it turning out for the best. Now, both sides continue to try to revoke those portions of the sequestration they dislike. The biggest part of the deficit reduction was due to tax increases, something the Dems wanted but which Obama fought up until this year. One of the biggest contributors was repeal of the cuts to FICA, something that was added in by Obama as 'stimulus' but which didn't do shit except increase the deficit. Only a nitwit like Krugman and his ilk would argue otherwise.

    Doubled the Stock Market: Whoopti-friggin-do. And the rich get richer and the poor get poorer. I'm sure the long-term unemployed are greatly impressed.

    Killed bin Laden: The CIA were tracking bin Laden's courier since 2007. In 2008/2009, he led them to bin Laden. Two years later they killed bin Laden. The entire operation, after identifying the courier, took a couple years to find bin Laden and a couple more to kill him. The operation started two years before Obama became president. The MSM made a big deal of what a gutsy decision Obama made in going in after bin Laden. How gutsy was it? Did he really have a choice? Can anyone imagine the repercussions if there had been a third chance to get bin Laden and Obama had failed to take it. Does anyone believe we would have ever seen the iconic photo-op of Obama and his team if things had gone badly?

    Other than his signature legislation with the ACA, Obama accomplished little of note during his first term. With the start of his second term, the goals he set for himself in his state of the union address seem to be falling apart under the weight of all the scandals.

    During his first term, anything negative that happened was Bush or the GOP's fault. Anything positive even, if only perceived, was always I, I, I, me, me, me. Now in his second term, his standard catch phrase is "Gosh I didn't know, I found out on TV the same as you".

    I don't know which is worse.

    This involved bombing the strategic port of Halifax and seizing other major ports that Britain might make use of in Canada. The strategy was even updated in 1934 to “make all necessary preparations for the use of chemical warfare from the outbreak of the war. The use of chemical warfare, including toxic agents, from the inception of hostilities, is authorized.”

    The U.S. was prepared — on paper at least — to gas its plaid neighbors as an opening volley in a war. It’s no wonder that news of this plan caused a stir in 1974 when it was declassified.

    An Islamist militant group is believed to be behind an attack on a rally by Indian Hindu nationalist politician Narendra Modi that killed six people and wounded more than 80, police said on Tuesday.
    Modi, who has a good chance of becoming India’s next prime minister, is seen as a target of militants who hold him responsible for riots a decade ago during his first term as chief minister of Gujarat state. At least 1,000 people, most of them Muslims, were killed in the rioting.

    Seven crude bombs went off on Sunday in Bihar state as Modi’s supporters gathered for his rally. He was not near any of the blasts and delivered his speech despite the attack.

    Senior police official S.N. Pradhan said one of two suspects arrested after the blasts had identified a suspected senior member of the Indian Mujahideen militant group, Tehseen Akhtar, as the organiser of the attack.

    The National Investigation Agency, India’s top counter terrorism body, is seeking the arrest of the 24-year-old Akhtar in connection with attacks in recent years in the cities of Mumbai and Varanasi and is investigating his role in blasts in Hyderabad city in February.

    “Because of the Tehseen connection, the entire chain is established,” said Pradhan, a senior police official in Jharkhand state, where the detained suspect is from.

    “There is no doubt that it is the work of the Indian Mujahideen.”

    Police said the bombers were trying to spark a stampede in the crowd. Heavy loss of life could have inflamed tension, recently simmering again, between majority Hindus and minority Muslims.

      A national anti-abortion conference is in Charlottetown this week with the ambitious goal of seeing new abortion laws introduced in Canada, and moving Canadian public opinion on abortion at the same time.

      The National Pro-Life Conference is looking to take some inspiration from being held on P.E.I., which is the only province in Canada where legal abortions are not performed.

      "I applaud P.E.I. for keeping it off the Island," delegate Natalie Sonnen told CBC News Thursday. She hopes P.E.I. will take it a step further, and stop funding out of province abortions too.

      "Every provincial government in Canada can spend their money the way they choose with regard to healthcare. And if they don't fund abortions, that's their prerogative," she said.

      Mike Schouten, a featured speaker at the conference, is setting his goals higher than that. He is leading a push to draw up a new abortion law that would protect a fetus under all circumstances. That would include cases of rape, incest, or severe fetal abnormalities.

      Polish behavior during World War Two was almost uniformly bad.

      Right before they were invaded they took the opportunity to gobble up a little territory to the south - at the time of Czechoslovakia, if memory serves. The gods being angered they were divided up themselves, invaded from both sides and began killing the Jews there. Finally they were over run by the Russians and these days are back more or less where started, minus the Jews of course, and still the antisemitism remains.
