US Constitution Too Vague for an Ordinary Citizen

The same judiciary that finds rights and privileges and meanings and new law anywhere and everywhere in the US Constitution finds that a citizen has no right to question whether the Constitution is being followed by requiring a candidate to prove they meet the qualifications to be President.

Judge tosses lawsuit challenging Obama citizenship

PHILADELPHIA (AP) - A federal judge has dismissed a lawsuit challenging Barack Obama's qualifications to be president.
U.S. District Judge R. Barclay Surrick on Friday night rejected the suit by attorney Philip J. Berg, who alleged that Obama was not a U.S. citizen and therefore ineligible for the presidency. Berg claimed that Obama is either a citizen of his father's native Kenya or became a citizen of Indonesia after he moved there as a boy.

Obama was born in Hawaii to an American mother and a Kenyan father. His parents divorced and his mother married an Indonesian man.

Internet-fueled conspiracy theories question whether Obama is a "natural-born citizen" as required by the Constitution for a presidential candidate and whether he lost his citizenship while living abroad.
Surrick ruled that Berg lacked standing to bring the case, saying any harm from an allegedly ineligible candidate was "too vague and its effects too attenuated to confer standing on any and all voters."

  3. I've noticed that a lot of lawyers and judges like to start their names with an initial--Judge R. Barclay Surrick. Nothing wrong in that of course. But I think--I'd bet--the percentage of initialers is higher among the legal profession that anywhere else.


    Plaintiff would have us derail the democratic process by invalidating a candidate for whom millions of people voted," Surrick states, "and who underwent excessive vetting during what was one of the most hotly contested presidential primary [sic] in living memory."

    Instead, Surrick cites Aritcle III of the U.S. Constitution, limiting federal judicial power to handling cases and controversies in which plaintiffs have clear standing through specific, personal injury.

    Berg, the judge ruled, simply didn't have a case for a particular injury and thus, had no standing to sue.

    Surrick's ruling cites a case deemed similar, Hollander v. McCain, in which it was alleged during the primary season that since he was born in the Panama Canal Zone, John McCain is not a natural-born citizen either. The judge in the Hollander case also ruled a voter cannot sue to prevent an allegedly unconstitutional candidate.

    Article III

    Section 1 - Judicial powers

    The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behavior, and shall, at stated Times, receive for their Services a Compensation which shall not be diminished during their Continuance in Office.

    Section 2 - Trial by Jury, Original Jurisdiction, Jury Trials

    (The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority; to all Cases affecting Ambassadors, other public Ministers and Consuls; to all Cases of admiralty and maritime Jurisdiction; to Controversies to which the United States shall be a Party; to Controversies between two or more States; between a State and Citizens of another State; between Citizens of different States; between Citizens of the same State claiming Lands under Grants of different States, and between a State, or the Citizens thereof, and foreign States, Citizens or Subjects.)     In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.

    The Trial of all Crimes, except in Cases of Impeachment, shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed; but when not committed within any State, the Trial shall be at such Place or Places as the Congress may by Law have directed.

    Section 3 - Treason Note

    Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

    The Congress shall have power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted.

    According to Judge Surrick, we the people have no right to police the eligibility requirements under the U.S. Constitution.

    We must legally prevent Obama, the unqualified candidate, from taking the Office of the Presidency of the United States,” Berg said.

  30. if you do a google search on Phil Berg, you'll find he is a flake who has filed all kind of bogus lawsuits, including against Bush, Cheny and the SCOTUS justices who ruled in his favor in 2000. Might have some bearing on how seriously any judge takes this guy.

  32. You're right jwillie, he seems to have a string of nonsensical cases, and yet those against Bush, Cheney et al were by a democrat. He's been a democrat, worked for them. And he held a responsible position for a long time, as an assitant DA or whatever his title.

    Seems like a reasonable request to me, to be able to see the proof of citizenship, when there's doubt in many minds. And his father was a Kenyan, step dad in Indonesia. Mother all over the place.

    We have no scholarly article written while at University of Chicago.

    We do not have his Selective Service record.

    We do not have an original Birth record.

    We do not have a signed embossed paper Certification of Live Birth.

    We do not have his State Senate Papers.

    We have no list of his law clients.

    We do not have his State Senate Schedule book.

    You are right. All we have is an official entry from his school stating that he was an Indonesian citizen and Muslim.
